Terms of Service

1. The Service

BGTFO provides tools to remove backgrounds from images you upload. We may change, suspend, or discontinue features at any time. We do not guarantee uninterrupted or error-free operation.

2. Accounts

Some features require an account. You must provide accurate information and keep your sign-in secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or create risk for us or other users.

3. Your content

You retain ownership of images and other materials you submit ("User Content"). You represent that you have the rights needed to submit User Content and that doing so does not violate anyone else's rights or applicable law.

You grant us a limited license to host, process, transmit, and display User Content solely as needed to operate and improve the Service (including routing it to our infrastructure and processing providers). This license ends when User Content is deleted, except where retention is required by law or reasonable backups.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, fraudulent, or abusive purposes.
• Upload content you do not have rights to use, or that infringes intellectual property, privacy, or publicity rights.
• Attempt to probe, scan, or test the vulnerability of the Service, or bypass rate limits, authentication, or security.
• Reverse engineer or scrape the Service except where applicable law forbids this restriction.
• Resell or commercially exploit the Service without our written permission.

5. Third-party services

The Service relies on third-party providers (for example, authentication, hosting, and image processing). Their terms and privacy practices may also apply. We are not responsible for third-party services we do not control.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR USE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BGTFO AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US$50), IF YOU HAVE NOT PAID US ANYTHING.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

8. Indemnity

You will defend and indemnify BGTFO and its affiliates, officers, and employees against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms.

9. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. If changes are material, we may provide additional notice. Continued use after changes means you accept the updated Terms.

10. General

These Terms are the entire agreement between you and BGTFO regarding the Service. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
